⚠️ Important legal notice: These Terms and Conditions are drafted in German and the German version is the legally binding version. This English translation is provided for informational purposes only. In the event of any discrepancies or disputes, the German version shall prevail exclusively.
1. Scope and contracting parties
1.1 Provider
These General Terms and Conditions (T&C) apply to all orders placed through the online shop teardropjewellery.com. The provider and contracting party is:

1.2 Customer base
Our offer is directed exclusively at consumers with residence in Switzerland who have reached the age of 18.
We reserve the right to reject orders from persons acting as commercial resellers.
1.3 Scope
These T&C apply in the version valid at the time of the order. Deviating conditions from the customer are not recognised unless we expressly consent to their applicability in writing.
1.4 Language
These T&C are drafted in German and the German version is the legally binding version. English or other translations are provided for informational purposes only — in the event of discrepancies or disputes, the German version shall prevail exclusively.
1.5 Subject of the contract
Via teardropjewellery.com, we sell stainless steel fashion jewellery (necklaces, earrings, rings, bracelets, bodychains) to consumers with residence in Switzerland.
2. Conclusion of the contract
2.1 Order process
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By clicking the order button "Buy Now" at checkout, you submit a binding order.
2.2 Order confirmation
After receipt of your order, you will automatically receive an order confirmation by email. This email confirms the receipt of your order — it does not yet constitute acceptance of the contract.
2.3 Conclusion of contract
The purchase contract is concluded as soon as we accept your order — at the latest, however, with the shipment of the goods and the corresponding shipping confirmation by email.
2.4 Right to reject orders
We reserve the right to reject an order in whole or in part — particularly in the case of:
- unavailable items (out of stock)
- justified suspicion of fraudulent orders
- payment problems (e.g. failed payment, declined card)
- obvious pricing or product errors on the website
- orders with delivery addresses outside Switzerland
- orders indicating commercial resale
In such cases, we will inform you promptly and refund any payments already made in full.
2.5 Product availability
Despite careful stock management, it may happen that an item is no longer available after ordering (e.g. due to simultaneous orders). In such cases, we will inform you promptly and offer you, at your choice:
- a replacement delivery (if available)
- a full refund of the corresponding amount
- delivery once back in stock (only with your consent)
2.6 Quantity limitation
We reserve the right to limit the order quantity per item and order to ensure fair availability for all customers. Orders of more than 10 identical items may only be processed after consultation or may be rejected entirely.
2.7 Storage of contract text
The ordering process and the T&C are stored electronically with us. You will receive the order confirmation with the most important contract information by email.

3. Prices
3.1 Currency and final prices
All prices listed on the website are in Swiss Francs (CHF) and are final prices.
3.2 Value Added Tax (VAT)
The business is not subject to VAT in accordance with Art. 10 para. 2 lit. a of the Swiss VAT Act (MWSTG) (annual turnover below CHF 100,000.–). Prices therefore do not include VAT.
3.3 Shipping costs
Shipping costs are charged in addition to the product price and are clearly displayed at checkout. Current shipping costs and conditions for free shipping can be found in our Shipping Policy.
3.4 Price changes
We reserve the right to adjust prices at any time. The price displayed in the shop at the time of your order is decisive.
4. Payment terms
4.1 Accepted payment methods
We accept the following payment methods:
- TWINT
- Credit cards: Visa, Mastercard, American Express (via Shopify Payments / Stripe)
- Apple Pay and Google Pay
- PayPal
4.2 Due date
Payment is due immediately upon order completion at checkout. Without successful payment, the order will not be processed.
4.3 Payment processing
Payment processing is carried out by external payment service providers. We do not store full credit card or bank details. Details can be found in our Privacy Policy.
4.4 Payment default
In the event of payment default or failed payment, the order may be cancelled. Goods already dispatched remain our property (see Section 9).
5. Discount codes, vouchers and promotions
5.1 General
We occasionally issue discount codes, promotion codes, and vouchers (e.g. via newsletter, pop-ups, influencer cooperations, or promotional campaigns).
5.2 Conditions
The following applies to discount codes and vouchers:
- Not combinable: only one code can be redeemed per order, unless expressly stated otherwise
- One use per person, unless expressly stated otherwise
- Not applicable to already discounted items, unless expressly stated otherwise
- Not redeemable for cash and not transferable
- Validity: unless otherwise communicated, codes are valid for 30 days from the date of issue
- Minimum order value: may vary depending on the promotion — communicated transparently with the code
5.3 In the event of return
If an item paid for with a discount code is returned:
- The actually paid amount (i.e. after deduction of the discount code) is refunded
- The discount code cannot be redeemed again after a return, unless expressly stated otherwise
5.4 Misuse
We reserve the right to cancel orders or revoke codes in the event of justified suspicion of code misuse (e.g. multiple use, transfer, manipulation).
6. Shipping and delivery
6.1 Shipping destinations
We deliver exclusively within Switzerland.
6.2 Shipping terms
All details on shipping costs, delivery times, tracking, and transfer of risk can be found in our Shipping Policy.
6.3 Transfer of risk
Upon handover of the goods to Swiss Post, the transport risk transfers to you as the buyer. We are not liable for delays, losses, or damages during transport — however, we actively support you with claims (see Shipping Policy, Sections 8–10).
6.4 Delivery times
The delivery times stated in the Shipping Policy are estimates and non-binding. Delays caused by the shipping carrier or by force majeure are outside our control (see Section 14).
7. Material information and allergy notice
7.1 Materials
Our products consist primarily of:
- 316L and 304L stainless steel (rust- and corrosion-resistant)
- 18K gold plating or rhodium coating (high-polish finish) with micron plating and e-coating shield for high durability
- Selected models also feature Cubic Zirconia stones (synthetic stones, not natural gemstones or diamonds)
7.2 Skin compatibility and allergies
Our jewellery is, according to our suppliers' information, nickel-free or nickel-low and therefore generally well tolerated by the skin.
⚠️ Important notice: Despite the use of skin-friendly materials, individual reactions cannot be entirely excluded in cases of very sensitive skin or known metal allergies. In the case of known metal allergies, we expressly recommend consulting a doctor or allergist before purchase.
We accept no liability for skin reactions resulting from individual sensitivities or existing allergies.
7.3 Product images
Product photos on our website are created with the greatest possible care. Minor deviations in colour, shine, or size between the product photo and the delivered goods may occur depending on screen calibration and lighting conditions, and do not constitute a defect.
8. Care instructions and warranty exclusions
8.1 Properties of our jewellery
Our products are:
- waterproof and can be worn while showering, swimming, and bathing
- sweat-resistant and suitable for everyday wear
- protected with micron plating and e-coating shield for maximum durability
8.2 Care instructions
Despite the high material quality, we recommend the following to maximise the lifespan:
- Avoid direct and prolonged contact with aggressive chemicals such as chlorine (swimming pool), bleach, acids, or solvents
- Avoid direct contact with perfume, creams, sunscreen, or makeup when putting on jewellery — allow these to absorb before wearing
- Clean the jewellery regularly with a soft cloth
- Store the jewellery dry, ideally in the original jewellery box
8.3 Warranty exclusion for improper care
Damage, discolouration, or wear that occurs due to improper care, rough handling, fall, breakage, or direct contact with aggressive chemicals does not constitute a warranty or guarantee claim and does not justify any entitlement to replacement, refund, or repair.
9. Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
10. Returns and right of withdrawal
10.1 Voluntary 14-day return policy
We voluntarily grant you a 14-day return right from the receipt of the goods. This right is a goodwill arrangement — Swiss law does not provide a statutory right of withdrawal for online purchases.
10.2 Excluded from the return policy
For hygiene, legal, and product-specific reasons, the following items are excluded from the return policy:
- Earrings and piercing jewellery, once worn (for hygiene reasons)
- Personalised items (engravings, custom orders)
- Sale and discounted items

11. Warranty (statutory rights for defects)
11.1 Statutory warranty
The statutory warranty rights under the Swiss Code of Obligations (Art. 197 ff. CO) apply. The warranty period is 2 years from receipt of the goods (Art. 210 para. 1 CO).
11.2 Liability as merchant
As the merchant, we are directly liable to the customer for defects — not the supplier or manufacturer. Warranty claims must be addressed exclusively to us.
11.3 Notification of defects
Defects must be reported to us within the warranty period via the contact form on teardropjewellery.com. Please send us:
- your order number
- a description of the defect
- photos documenting the defect
11.4 Legal consequences of defects
For justified defect claims, we decide on a case-by-case basis which of the following options to offer:
- Repair / rectification
- Replacement delivery of the defective item
- Full refund of the purchase price including original shipping costs
We choose the solution at our reasonable discretion, taking your interests into account.
11.5 Exclusion
The warranty does not apply to damages resulting from improper care or handling (see Section 8), normal wear from use, or external force.
12. Limitation of liability
12.1 General
We are liable for damages you suffer through our products or our website only in cases of intent or gross negligence.
12.2 Excluded liability
To the extent legally permissible, we exclude liability for:
- damage from improper care or application of the jewellery
- individual skin reactions or allergic reactions (see Section 7.2)
- damage from external force or normal wear
- indirect damages, consequential damages, or loss of profit
- content and services of external websites to which we link
12.3 Unaffected liability
The mandatory statutory liability provisions — in particular under the Swiss Product Liability Act (PrHG) and for personal injury — remain unaffected by this clause.
13. Marketing communication to existing customers
As an existing customer (i.e. after a completed order), we may, in accordance with Art. 3 lit. o of the Swiss Federal Act against Unfair Competition (UWG), send you emails about similar products and promotions without further consent — e.g. our newsletter with new jewellery arrivals.
You can object to receiving such marketing emails free of charge at any time:
- via the unsubscribe link in every email
- or via our contact form
After your objection, we will not send you any further marketing emails — transactional emails (e.g. order confirmations, shipping notifications) will continue to be sent.
14. Force majeure
We are not liable for delays, non-delivery, or other contractual disruptions due to force majeure.
Force majeure shall be deemed to include in particular:
- natural disasters (earthquakes, floods, etc.)
- pandemics and official measures (e.g. quarantine, lockdowns)
- strikes, lockouts, and other labour disputes
- war, terrorism, and political unrest
- cyber attacks on our systems or those of our service providers
- failure of essential service providers (Shopify, Swiss Post, payment service providers)
- power, internet, or supply chain outages
In cases of force majeure, agreed performance and delivery deadlines are extended accordingly. If a force majeure event lasts longer than 60 days, both parties have the right to withdraw from the contract — payments already made will be refunded in full in this case.
15. Intellectual property
All content on our website — in particular logos, brand names, texts, product photos, graphics, and the entire design — is protected by the Swiss Copyright Act (URG) and, where applicable, other intellectual property rights.
Reproduction, distribution, modification, or other use — even in part — is prohibited without our express written consent.
16. Data protection
The protection of your personal data is important to us. What data we process for what purpose can be found in our Privacy Policy and Cookie Policy.
17. Dispute resolution
17.1 Amicable solution
For complaints or claims, please first contact us directly via the contact form on teardropjewellery.com. We strive to find a fast, fair, and customer-friendly solution.
17.2 Conciliation procedure
For consumer disputes with a value in dispute below CHF 30,000.–, Swiss law requires a conciliation procedure before the competent cantonal conciliation authority at the consumer's place of residence to be conducted before court proceedings can be initiated (Art. 197 ff. of the Swiss Civil Procedure Code, ZPO).
18. Applicable law and place of jurisdiction
18.1 Applicable law
Swiss law applies exclusively, with the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
18.2 Place of jurisdiction
If the customer is a consumer, the statutory place of jurisdiction at the consumer's place of residence applies.
Otherwise, the place of jurisdiction is the registered office of the owner (Dietikon, Canton of Zurich).
19. Severability clause
If individual provisions of these T&C are or become invalid, void, or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected.
In place of the invalid provision, the legally permissible provision that comes closest to the economic purpose of the invalid provision shall apply.
20. Changes to the T&C
We reserve the right to amend these T&C at any time. The version published in the shop at the time of the order is decisive for each order.
